#SXSW #CrimeScene 2 Dead After Rashad Charjuan Owens 22 Plows Through Police Barricade

Newsflash from your Hollywood Attorney:

The identified, is in custody and will be charged with two counts of capital murder and 23 counts of aggravated assault with a vehicle.

11:50 a.m.: The American-Statesman has confirmed the identity of the suspect in last night’s SXSW incident. He is Rashad Charjuan Owens, 22, of Killeen.

11:15 a.m. update: Police are waiting to file capital murder charges against a suspected drunken driver who plowed through a crowd of South by Southwest festival-goers early Thursday morning in downtown Austin before they identify him.

Police Chief Art Acevedo said the man will face two charges of capital murder and 23 counts of aggravated assault. The name of the suspect is expected to be released Thursday afternoon, Acevedo said.

Police also clarified who was killed in the incident. One of the dead, a man from the Netherlands, was riding a bicycle near the intersection of 11th and Red River streets when struck. The other, an Austin woman on a moped, also was killed. Both were pronounced dead at the scene, officials said.

Another man on the moped is in stable condition, Acevedo said.

Earlier:
A driver attempting to evade a drunk driving stop hurtled past a barricade on Red River Street and plowed through dozens of SXSW revelers, killing two and injuring 23 in a horrific scene early Thursday morning, police said. The street, home to many popular clubs hosting South by Southwest music showcases, had been closed to motorists and was crowded with music fans waiting to get into the Mohawk nightclub.

According to police, the man, driving a small Toyota car, went the wrong way down Ninth Street after evading a stop at a gas station around 12:30 a.m., turned onto Red River and drove for more than two blocks, striking numerous pedestrians before hitting a scooter traveling on 11th Street, killing a woman who was on board. The driver then struck a taxi, injuring two, and crashed into a parked van, Police Chief Art Acevedo said. A male cyclist from the Netherlands also was killed, he said Thursday morning.

The male driver of the scooter was in stable condition, Acevedo said. It had initially been reported that both people on the scooter had been killed.

The driver then attempted to flee on foot before he was stunned with a Taser gun and detained by the police officer who originally tried to pull the man over at a gas station on the frontage road of Interstate 35.

Speaking to reporters on Red River Street, which was still littered with shoes, clothing and other debris from the incident, Acevedo vowed the man would face capital murder charges in the deaths of the two scooter riders and 23 counts of aggravated assault with a vehicle.

Acevedo did not identify the suspect, who was alone in the car, but said police would provide more information later Thursday.

University Medical Center Brackenridge officials said at Thursday morning that eight of the 23 victims from the crash had been taken there. Two patients are critically injured, both with head injuries. One in is intensive care, the other in the Special Procedures Lab. Their prognosis is “worrisome.”

Three others are in serious condition, with a spinal fracture, minor head injuries and other problems. One is in good condotion, and two were treated for minor injuries and released, including the driver. Most of the victims were in their 20s.

Five people were critically injured and taken to University Medical Center Brackenridge within 15 minutes of the accident, emergency officials said.

Scott Jakota, a musician from Indiana in town to play SXSW, said he was one of the first people hit. He said the driver “gunned” the car, “and I was thrown up in the sky.” He appeared to have a leg injury and was being helped by his friends.

Ally Hulton, a 28-year-old from Los Angeles, was smoking a cigarette on the balcony of her friend’s apartment on Red River when she saw a car drive down the street “at full speed” before hitting someone.

It then appeared to accelerate into a crowd of people, she said.
“About 10 bodies went flying,” Hulton said.

A Statesman photographer on the balcony of the Mohawk at the time of the incident said he saw some bystanders attempting to provide first aid to victims while others sat stunned on curbs with their hands over their mouths. He said the band playing at the time, X, finished its set, unaware of what had happened.

A large section of Red River will be closed for most of the day Thursday, although police hope to open intersections by morning rush hour.

Shortly before 3 a.m. Mayor Lee Leffingwell expressed his condolences. “Our thoughts and prayers are with the families of the victims, as well as those being treated in area hospitals,” Leffingwell said in a statement. “The Austin Police department is investigating this matter as allegedly involving drunk driving. If this is true, this fact angers me. Drunk driving is never acceptable, and can lead to deadly consequences.”

Transmission Events, which owns the Mohawk, said on Twitter: “Our thoughts and prayers are with the families of the victims and injured from tonight’s tragedy. Please check and make sure everyone you know is home safe tonight.”

Acevedo said an officer assigned to a DWI detail attempted to pull the driver over at the Shell gasoline station at Ninth Street and the frontage road of Interstate 35. Acevedo said the man weaved through the crowded station to avoid the officer and then “accelerated at a high rate of speed” the wrong way on Ninth Street before turning onto Red River. The barricade was manned by a police officer who was forced out of the way by the onrushing car.

Acevedo said there was little that could have been done to stop the driver’s rampage. “This traffic management plan is a plan that has worked for many years, and obviously when we have something like this, we will review it,” he said. “But when somebody decides to do the things that this man did, it’s part of life and ultimately we have to hold people accountable for their actions. This individual acted in a reckless, willful disregard for the people that were here at this event.”
With additional reporting by Peter Blackstock, Nancy Flores, Ben Wermund and Jay Janner

Earlier:
According to Austin Police Chief Art Acevedo, at about 12:30 a.m. Thursday, an APD officer who is part of a DWI task force attempted to stop a driver of a gray Toyota sedan at a Shell gas station on the Interstate 35 frontage road. The driver evaded the stop and weaved his way through the other cars at the station and headed west down Ninth Street, the wrong direction on a one-way street.

At Red River, he took a right, barrelled through the barricade, which was manned by a police officer, who jumped out of the way to avoid being hit. The driver accelerated at a high rate of speed, according to Acevedo, and struck multiple pedestrians on Red River, which was closed to street traffic and was full of people lined up outside the Mohawk. He drove two blocks through the pedestrians and at 11th, he struck a moped with a man and woman, who both died at the scene, Acevedo said.

The driver kept going, hit a taxi and a parked van, before jumping out of the car and fleeing on foot. The same officer who initiated the stop chased him all the way through and tased him, the police chief said.

Twenty-three people were injured, five of them critical. The more seriously injured were transported to University Medical Center Brackenridge within 15 minutes of the accident, Acevedo said.

The driver, who police have not yet identified, is in custody and will be charged with two counts of capital murder and 23 counts of aggravated assault with a vehicle.

A large section of Red River will be closed for most of the day Thursday, although police hope to open intersections by morning rush hour.

Earlier:
At least two are dead and 21 injured after a car drove through barricades and into a crowd of South of Southwest festival goers outside of the Mohawk music club on Red River Street downtown early Thursday morning, police officials say.

Police, who are holding a news conference, said the driver was taken into custody.

Lt. Brian Moon told the Associated Press that two victims were confirmed dead at the scene and that 21 others were transported to hospitals, about five to seven with serious injuries.

John Wickham, owner of nearby Elysium, was on the upper level of the Mohawk during a SXSW showcase by X, and told the Statesman he saw a car coming down the street fast with a police car in pursuit. He saw the car hit several people. He said he did not see the police car hit anyone.

Scott Jakota from Indiana said the car that came through the barricade was a gray Prius, and he was one of the first people hit. He said the driver gunned the car, “and I was thrown up in the sky.” He appeared to have a leg injury and was being helped by his friends.

Red River Street was closed to traffic for several blocks, including the block in front of the Mohawk. Separate groups of SXSW badgeholders and non-badgeholders were lined up in the street at the time of the incident.

Transmission Events, which owns the Mohawk, said on Twitter: “Our thoughts and prayers are with the families of the victims and injured from tonight’s tragedy. Please check and make sure everyone you know is home safe tonight.”

Brittany Murphy was Poisoned to Death and Under Surveillance

Newsflash from your Hollywood Attorney:

Ever since her untimely death at the young age of 32, Brittany Murphy’s father Angelo Bertolotti has been claiming that his daughter was murdered. Brittany was found dead on December 20th 2009 and her husband, Simon Jack, was found dead just five months later on May 23rd 2010 – in the same bedroom and under the same circumstances. According to authorities, the cause of Brittany’s death was “pneumonia, anemia and a toxic cocktail of drugs”.

However, new tests conducted by independent Carlson Company laboratories have found that high amounts of ten heavy metals were found in Brittany’s system at the time of her death. The lab report even goes as far as stating there was “likely criminal intent”.

“Ten (10) of the heavy metals evaluated were detected at levels higher that the WHO [The World Health Organization] high levels. Testing the hair strand sample identified as  “back of the head” we have detected ten (10) heavy metals at levels above the WHO high levels recommendation. If we were to eliminate the possibility of a simultaneous accidental heavy metals exposure to the sample donor then the only logical explanation would be an exposure to these metals (toxins) administered by a third party perpetrator with likely criminal intent.”  - Examiner.com, Brittany Murphy did not die of natural causes, lab report shows

These new test results now lead observers to believe that Murphy was probably given rat poison or a similar product.

“Heavy metals are found in most rodenticides and insecticides meaning the actress could have been slipped rat poisoning or bug killer.

At the time of her death, Brittany displayed all the symptoms of heavy metal poisoning including: headaches, dizziness, abdominal cramps, coughing, sweating, disorientation, wheezing, congestion and pneumonia.

Mr Monjack also exhibited similar symptoms before his death, leading some to believe he too was poisoned.”

- Mail Online, Revealed: Brittany Murphy ‘was poisoned by government spooks in revenge for star’s support of whistleblower’, claims her grief-striken father

Brittany Murphy’s was mentioned a few times on Vigilant Citizen as her death is a classic case of  “mysterious celebrity death” surrounded by odd facts and strange symbolism.

According to her father and friend Julia Davis, Brittany was under constant surveillance by a “shadowy government organization”.

“In a recent interview with Los Angeles-based Fleur De Lis Film Studios, Mr Bertolotti said:  ‘They were, in fact, under surveillance, including helicopters. Their telephones were wiretapped, Brittany was afraid to go home, because of the sneak-and-peek incursions into their residence and other terror tactics she suffered after speaking out in support of Julia Davis and being named as a witness in her lawsuit against the Department of Homeland Security.”

They believe that Brittany’s support for Julia Davis, a government whistle-blower, caused her to be a target of heavy surveillance.

“This included warrantless aerial surveillance with fixed-wing airplanes and Blackhawk helicopters, vehicular surveillance, OnStar tracking, Internet monitoring, wiretaps, warrantless searches and seizures and series of other outrageous, unwarranted retaliatory measures.”

Like most celebrities who lost their lives in strange circumstances, Brittany was described by mass media as a drug addict. The house she was living in was bought fully furnished from Britney Spears in 2003, a celebrity that is fully controlled and monitored by Hollywood handlers. Was this house “infiltrated”? Was Brittany Murphy living under the same circumstances as Britney Spears? Did she lose her life because she was breaking out of programming? Some of the truth appears to be slowly coming out.

NFL Star Arron Hernandez's Friend Turns Himself in to Florida Police 3rd Wanted Armed & Dangerous

A third suspect wanted in the murder case involving ex-Patriots player Aaron Hernandez has turned himself in, authorities say.
Ernest Wallace, who police had been searching for since Thursday night, turned himself in to Florida police Friday.

Wallace reportedly had seen news reports about the case and went to authorities, a Miramar police spokesman said. He is wanted for accessory after the fact of the murder of semi-pro football player Odin Lloyd last week in North Attleborough, Mass., near Hernandez's home.

Massachusetts authorities had recovered a car linked to Wallace Friday afternoon. Police had said Wallace should be considered armed and dangerous.

Wallace is believed to be a resident of Hernandez's hometown of Bristol, Conn., MyFoxBoston.com reported.

Meanwhile, a judge in Bristol ordered Carlos Ortiz, who was arrested Wednesday as part of the murder probe, to be turned over to Massachusetts authorities.

Ortiz, 27, was charged in Connecticut as a fugitive from justice.

Hernandez has been charged with murder for what prosecutors say was Lloyd's execution-style killing. He has pleaded not guilty and is being held without bail.

A source told MyFoxBoston.com on Thursday that investigators are looking into Hernandez in connection with a double homicide that happened on July 16, 2012, in downtown Boston.

The source told the station that a fight broke out at a club between the two male shooting victims and a group that reportedly included Hernandez.

An email and phone call to Boston Police from FoxNews.com were not immediately returned.

Hernandez's lawyer argued at Thursday's bail hearing that his celebrity status means even if he wanted to flee he couldn't and that the case against him is circumstantial.

"He wants to clear his name," lawyer James Sultan told the judge.

But Bristol County Assistant District Attorney Bill McCauley called the evidence in the June 17 slaying of Lloyd overwhelming and said police had made discoveries Wednesday when they searched a condo Hernandez leased and a Hummer registered to him that was parked there.

Hernandez appeared in court with his hands cuffed in front of him and occasionally looked at his fiancee during Thursday's bail hearing. She cried when Bristol Superior Court Judge Renee Dupuis denied the request, but Hernandez showed little emotion.

The judge said that it is rare for someone charged with first-degree murder to get bail and that Hernandez had the means to flee if he chose to do so. She acknowledged the prosecution's case was circumstantial but said it was "very, very strong" and called the scenario the prosecution described "cold-blooded."

The Patriots cut Hernandez shortly after police arrested him on Wednesday.

A jogger found Lloyd's body in a remote area of an industrial park about a mile from Hernandez's home in North Attleborough 10 days ago. Lloyd was a semi-pro football player from Boston who was dating the sister of Hernandez's fiancee.

Prosecutors said Hernandez orchestrated the killing because Lloyd talked to the wrong people at a nightclub. Hernandez, a 2011 Pro Bowl selection who signed a five-year contract with the Patriots worth $40 million, could face life in prison if convicted.

In laying out more of the government's case Thursday, McCauley said prosecutors believe that the murder weapon was a .45-caliber Glock and that a gun Hernandez is seen holding on his home surveillance video, a weapon they haven't found, appears to be a Glock.

The prosecutor said that inside the Hummer investigators recovered an ammunition clip for .45-caliber bullets and that ammunition was found inside the condo. McCauley said a photograph had emerged online of Hernandez holding a Glock.

Hernandez's lawyer said Thursday that as far as he knew there was no eyewitness testimony and the prosecution had not given evidence that shows who shot Lloyd or whether there was a plan to kill him. He said Hernandez has no criminal record, owns a home and lives with his 8-month-old daughter and fiancee.

"Mr. Hernandez is not just a football player but is one of the best football players in the United States of America," Sultan said, adding, "He's young man who is extremely accomplished and hardworking in his chosen profession."

Prosecutors have said that on June 16 Hernandez and two unidentified friends picked up Lloyd from his Boston home in a rented silver Nissan Maxima, took him to a remote area of an industrial park and shot him five times.

Lloyd, in the minutes before his death, sent a series of texts to his sister, who had seen him get into the car.

"Did you see who I was with?" said the first, at 3:07 a.m. June 17.

"Who?" she finally replied.

"NFL," he texted back, then added: "Just so you know."

Aaron Hernandez Dropped by "Puma" Gang Member and Double Murder

NFL star Aaron Hernandez' biggest sponsor PUMA has just dropped him like a hot potato.

A rep for PUMA tells TMZ, "PUMA has ended the relationship with athlete Aaron Hernandez in light of the current situation."

Hernandez signed the 2-year endorsement deal with PUMA in April 2013 as the face of its "training category." It's unclear how much the deal was worth ... but safe to say, a lot.

As we reported, Hernandez is currently in custody awaiting his murder trial. Hernandez was charged with 1st degree murder and 5 other gun-related charges in connection with the death of a 27-year-old former semi-pro football player named Odin Lloy

Bail Denied for NFL Aaron Hernandez with a Trial Not in the Near Future

NFL star and murder suspect Aaron Hernandez has just been denied bail ... meaning he'll rot behind bars until his trial ... and that could take forever.

Hernandez was present in court today for a bail review hearing, where his lawyer begged the judge to release Hernandez from custody while he awaits trial.

But the judge wasn't moved by his arguments -- that Hernandez is an upstanding citizen and family man with no flight risk -- claiming the prosecution already had very strong evidence that Hernandez had committed the crime.

As for the evidence ... the prosecutor went through the entire timeline leading up to the murder of Odin Lloyd earlier this month, including matching shell casings found at the murder scene and inside Hernandez' rental car. He also mentioned the photo TMZ posted last night -- showing Hernandez brandishing a glock in the mirror 4 years ago -- claiming it's possible the murder weapon was also a glock.

The prosecutor said they'd be seeking the max sentence for Hernandez ... life without parole.

Hernandez' fiancee -- who was also present in court -- was inconsolable when the judge issued her decision to keep the NFL star behind bars.

As we reported, Hernandez was remanded into custody yesterday following his arraignment and was ordered to be held WITHOUT bail.

Hernandez has been charged with murder in the death of 27-year-old Odin Lloyd. He's also been hit with 5 gun-related charges.

NFL Patriots Aaron Hernandez Charged With Murder

Update 2:42 p.m.: Hernandez has been charged with murder. See more details below.

Original Post: NFL tight end Aaron Hernandez, who has been embroiled in a murder investigation for more than a week, was taken from his home in handcuffs this morning, leading to speculation he may soon be charged in the shooting death of a close "associate." Massachusetts State Police say the charges will be revealed when he appears in court later today.

Police have been surprisingly quiet about their findings in the case of Odin Lloyd, an associate of Hernandez's who was found dead near the New England Patriot's home on June 17. As recently as yesterday, they were insisting that no suspects had been named in the murder case and they even got a judge to seal all documents in the case. Yet police showed up at his house this morning, placed the 23-year-old in handcuffs, and took him away in a police cruiser. It appears he was not given a chance to surrender voluntarily.

According to various law enforcement leaks, Hernandez was allegedly with the victim on the night he was killed and possibly tampered with potential evidence before police could review it. There were multiple reports last week that he would be arrested for obstruction of justice, but that never came to pass. (Or it just did; but several days too late.)

Officer from New Jersey killed a Man in Road Rage in Md.

A police officer from New Jersey shot and killed a Maryland man after a reported road-rage incident on a highway in Anne Arundel County, the Maryland state police said.

The shooting occurred about 8:30 p.m. Saturday on the shoulder of a ramp from Route 3 to Interstate 97 in the Millersville area, police said.

State police identified the victim as Joseph Harvey Jr., 36. They gave a Baltimore County address, but a relative said he lived in Anne Arundel. Police identified the suspect as Joseph Walker, 40, of Eastampton, N.J., and said he was charged with second-degree murder and manslaughter.

After driving a Honda with one passenger inside onto Route 3 shortly before the shooting, police said, the victim “came into contact” with the officer, who was driving a Kia minivan. The contact was not described.

Harvey’s car stopped on the shoulder of the off-ramp and Harvey “began walking toward” the officer, who had parked about 100 to 150 feet behind, police said. One state police account said Harvey and his passenger both got out of the Honda but that only Harvey walked toward the minivan.

As Harvey approached, the account said, Walker got out off his vehicle and allegedly said he was an officer. Harvey kept approaching “in a reportedly aggressive manner,” the account said. Police said the officer fired a pistol “in the direction” of Harvey, who was hit and fatally wounded.

The police said Walker was a sworn officer with the prosecutor’s office in Hudson County.

Doctor accused of severing babies' spines with scissors in 'house of murder horrors'

The Hippocratic Oath, when properly translated, doesn't actually say, "First, do no harm." But since the time of the ancient Greeks, that's become the mantra for every medical professional.

The 72-year-old Philadephia physician is accused of running a "house of horrors" where he performed illegal abortions past the 24-week limit prescribed by law. He used scissors, authorities say, to sever the spinal cords of newborns who emerged from their mothers still alive.

On Monday, jury selection begins in Gosnell's trial. If he's convicted, prosecutors want him put to death.

"A doctor who cuts into the necks severing the spinal cords of living, breathing babies, who would survive with proper medical attention, is committing murder under the law," Philadelphia District Attorney Seth Williams said.

The charges
Gosnell faces eight counts of murder: for the deaths of seven babies, and in the case of a 41-year-old woman who died of an anesthetic overdose during a second-trimester abortion.

The babies were born alive in the sixth, seventh and eighth months of pregnancy -- but their spinal cords were severed with scissors, Williams said.

"It was a house of horrors beyond any type of definition or explanation I can humbly try to give," Williams told CNN in January 2011, shortly after Gosnell was charged.

"And it's very sad for the women that were there, that were subjected to such horrific and barbaric -- I would say medical treatment, but it wasn't medical -- treatment."

Several other people who worked in the west Philadelphia medical office have already pleaded guilty to related charges.

A judge involved in the case said in 2011 that one of those employees was expected to testify against Gosnell.

"Dr. Gosnell should enjoy the same presumption of innocence anyone in this country, you or me, should get if we were charged with a crime," said attorney William J. Brennan.

 The scene
When authorities searched Gosnell's office, they found bags and bottles holding aborted fetuses scattered throughout the building.

Jars containing the severed feet of babies lined a shelf. Furniture and equipment was blood-stained, dusty and broken.

"My grasp of the English language doesn't really allow me to fully describe how horrific this clinic was -- rotting bodies, fetal remains, the smell of urine throughout, blood-stained."

"The baby had been born and was on a cold steel table and murdered by using -- there's no medical basis for snipping or taking scissors and putting them into the neck and cutting, severing the spinal cord. It's just homicide. It's just murder," Williams told CNN.

A grand jury investigation determined that health and licensing officials had received repeated reports about Gosnell's practices for two decades, but had taken no action, Williams said.

According to Philly.Com, a joint website of the Philadelphia Daily News and the Philadelphia Inquirer, Gosnell was back in court last Thursday, to mull a possible plea bargain.
