Wall Street’s Top Stock Trading Firm SAC Indicted on $10 Billion Hedge Fraud Fund Charges

Newsflash from your Hollywood Attorney:

A huge defeat on Thursday after a federal grand jury indicted SAC Capital Advisors on fraud charges.

According to the indictment SAC both obtained on inside information and traded on it between 1999 to 2010, boosting returns for investors along with fees for the firm. The charges also allege that the insider trading scheme ran into the very core of the firm, involving portfolio managers, research analysis and dozens of publicly traded companies.

The case has been closely followed by the finance world due to the potential blowback against SAC founder Steve A. Cohen, the billionaire hedge fund manager that has so far eluded indictment, including in today’s filing in a Manhattan federal court.

The US Securities and Exchange Commission has, however, already filed civil charges against Cohen, the 35th richest man in the US according to a 2011 Forbes ranking, for what it said was a failure to adequately supervise the people at his firm.

US Attorney Preet Bharara said at a news conference on Thursday that SAC was "a magnet for market cheaters."

FBI Assistant Director George Venizelos echoed that sentiment, saying that "this is a case about corporate conduct and corporate responsibility. SAC Capital and its management fostered a culture of permissiveness. SAC not only tolerated cheating, it encouraged it."

The indictment against SAC, which oversees some $10 billion worth of assets, alleges that the firm intentionally recruited portfolio managers and analysts that had proven access to public company contacts with insider information. Those managers and analysts were then not second guessed when they made trading recommendations that seemed clearly rooted on insider information.

The "relentless pursuit of an information 'edge' fostered a business culture within SAC in which there was no meaningful commitment to ensure that such 'edge' came from legitimate research and not inside information," reads Thursday’s court filing.

"The predictable and foreseeable result, as charged herein, was systematic insider trading by the SAC entity defendants resulting in hundreds of millions of dollars of illegal profits and avoided losses at the expense of members of the investing public."

With the indictment, analysts believe that SAC is essentially being put out of business by federal investigators. Along with the charges the government is also looking to force SAC to surrender any fraud-related profits.

“In particular, at all relevant times the SAC Owner required each [portfolio manager] to share ‘high conviction’ investment ideas–i.e., the investment  recommendations in which the SAC [portfolio managers] had the greatest confidence –with the SAC Owner. In fact, providing such ideas to the SAC Owner was an express part of a SAC PM’s duties and was emphasized to SAC [portfolio managers] in the hiring process and once working at SAC.”

The case is said to be the most aggressive yet by the top federal prosecutor in New York, Preet Bharara, who has overseen a crackdown on insider trading cases.

Though grassroots movements like Occupy Wall Street have long demanded that bankers be held accountable for corruption, claiming that the federal government is not doing enough to prosecute white collar criminals, Wall Street was stunned nonetheless when a series of criminal insider trading charges emerged in 2009.

In one of the biggest cases involving insider trading Raj Rajaratnam, the founder of the Galleon Group hedge fund, was sentenced to 11 years in prison on October of 2011. Prior to its collapse in 2009 on the heels of an insider trading investigation, Galleon was one of the largest hedge fund management firms in the world, managing over $7 billion worth of investments.

Woman Freed after Passengers Push a 32-Ton Train Car

Newsflash from your Hollywood Attorney:

Bravo to Dozens of Japanese train passengers pushed a 32-ton train carriage away from the platform to free a woman who had fallen into the 20-centimeter (eight-inch) gap between the train and platform during the busy morning rush hour Monday.

The act of heroism was captured by a newspaper photographer, whose photo of the rescue ran in the Yomiuri daily's evening edition.

A public announcement that a passenger was trapped prompted about 40 people to join train officials to push the carriage, whose suspension system allows it to lean to either side, according to the Yomiuri newspaper, Japan's largest daily.

The unnamed woman in her 30s was then pulled out uninjured to applause from onlookers at JR Minami-Urawa station, just north of Tokyo.

After just an eight-minute delay, the train went on its way.

Deborah Dalelv, Rape Victim, then Sentenced To Jail For Sex Outside Of Marriage In Dubai as 4 Men Watch - Now Pardoned

Newsflash from your Hollywood Attorney:

A Norwegian woman sentenced to 16 months in jail in Dubai for having sex outside marriage after she reported an alleged rape said Friday she decided to speak out in hopes of drawing attention to the risks of outsiders misunderstanding the Islamic-influenced legal codes in this cosmopolitan city.

The case has drawn outrage from rights groups and others in the West since the 24-year-old interior designer was sentenced Wednesday. It also highlights the increasingly frequent tensions between the United Arab Emirates' international atmosphere and its legal system, which is strongly influenced by Islamic traditions in a nation where foreign workers and visitors greatly outnumber locals.

"I have to spread the word. ... After my sentence we thought, `How can it get worse?'" Marte Deborah Dalelv told The Associated Press in an interview at a Norwegian aid compound in Dubai where she is preparing her appeal scheduled for early September.

Dalelv, who worked for an interior design firm in Qatar since 2011, claims she was sexually assaulted by a co-worker in March while she was attending a business meeting in Dubai.

She said she fled to the hotel lobby and asked for the police to be called. The hotel staff asked if she was sure she wanted to involve the police, Dalelv said.

"Of course I want to call the police," she said. "That is the natural reaction where I am from."

Dalelv said she was given a medical examination seeking evidence of the alleged rape and underwent a blood test for alcohol. Such tests are commonly given in the UAE for alleged assaults and in other cases. Alcohol is sold widely across Dubai, but public intoxication can bring charges.

The AP does not identity the names of alleged sexual assault victims, but Dalelv went public voluntarily to talk to media.

Dalelv was detained for four days after being accused of having sex outside marriage, which is outlawed in the UAE although the law is not actively enforced for tourists as well as hundreds of thousands of Westerners and others on resident visas.

She managed to reach her stepfather in Norway after being loaned a phone card by another woman in custody.

"My stepdad, he answered the phone, so I said, that I had been raped, I am in prison ... please call the embassy," she recounted.

"And then I went back and I ... just had a breakdown," she continued. "It was very emotional, to call my dad and tell him what happened."

Norwegian diplomats later secured her release and she has been allowed to remain at the Norwegian Seamen's Center in central Dubai. She said her alleged attacker received a 13-month sentence for out-of-wedlock sex and alcohol consumption.

Dubai authorities did not respond to calls for comment, but the case has brought strong criticism from Norwegian officials and activists.

"This verdict flies in the face of our notion of justice," Norway's foreign minister, Espen Barth Eide, told the NTB news agency, calling it "highly problematic from a human rights perspective."

Previous cases in the UAE have raised similar questions, with alleged sexual assault victims facing charges for sex-related offenses. Other legal codes also have been criticized for being at odds with the Western-style openness promoted by Dubai.

On Thursday, Dubai police said they arrested a man who posted an Internet video of an Emirati beating a South Asian van driver after an apparent traffic altercation. Police said they took the action because images of a potential crime were "shared."

In London, a spokesman for the Emirates Center for Human Rights, a group monitoring UAE affairs, said the Dalelv case points out the need for the UAE to expand its legal protections for alleged rape victims.

George Zimmerman, Judge has 2 Issues, Zimmerman is suing NBC News, Bodyguards are Suing Him and Possibly More Lawsuits

Newsflash from your Hollywood Attorney:

Moments after the six-member jury found that Zimmerman had not committed a crime when he killed Trayvon Martin, Circuit Judge Debra S. Nelson told the former neighborhood watch volunteer, "You have no further business with the court."

But Nelson has two issues yet to decide: how long to keep juror names secret and whether to fine prosecutors for behavior that defense attorneys say was unethical. Two civil suits are also pending.

The identities of the six women who served as Zimmerman's jury are a secret because of an order by the judge. How long they will remain so is an open question.

Defense attorney Mark O'Mara initially asked that their names be kept under seal permanently, but after more than a dozen media companies objected, Nelson rejected that request.

She signed an order ruling that their names would remain secret during the trial.

O'Mara asked that that be extended for six months. "This should be a sufficient amount of time for any community passions to cool, should an acquittal occur," he wrote in a motion filed June 25, after the jury was sworn in and had begun hearing evidence.

An allegation that prosecutors failed to give defense attorneys damaging evidence from Martin's cellphone and a resulting debate over whether the prosecutors should be sanctioned provided some riveting moments just before the trial began.

Defense attorney Don West was on the witness stand June 6 testifying about what happened and was being cross-examined by Assistant State Atty. Bernie de la Rionda, the lawyer West accused of malfeasance.

"We caught you hiding the information and confronted you about it, and you never gave it to us," West said.

Moments later, when O'Mara tried to call De la Rionda to the witness stand, the prosecutor refused.

O'Mara then suggested prosecutors may have committed "direct criminal contempt," prompting the judge to halt the hearing and say she would take it up after the trial.

She is expected to set a hearing soon.

With the trial over, many who follow the case are speculating about lawsuits yet to be filed: Will Martin's parents sue Zimmerman? Will Zimmerman seek damages?

Two suits are already pending. In one, Zimmerman is suing NBC News, alleging defamation.

He accuses the organization of splicing together two separate portions of his call to police the night of the shooting to make it seem as if he had, unprompted, blurted out that Martin was black. In reality, Zimmerman was answering a question from the dispatcher.

The suit also accuses the network of falsely reporting that during the call, Zimmerman used a racial epithet.

"Defendants pounced on the Zimmerman/Martin matter because they knew this tragedy could be, with proper sensationalizing and manipulation, a racial powder keg that would result in months, if not years, of topics for their failing news programs," the suit says.

NBC said in a court filing that there was no basis for the suit and that it had "fairly and accurately reported about a news event that has captivated the nation."

Court to Releases $1.9 Million in Stolen Money to Horror Filmmaker

Newsflash from your Hollywood Attorney:

Matthew Arnold, the writer-director of Shadow People and the showrunner behind NBC's new supernatural drama Siberia, has gotten a California appeals court to affirm the release of nearly $2 million of raised money that landed in the bank accounts of one of his former students.

Shadow People, based on a true story about a small-town radio personality who unravels a conspiracy, was picked up at the Cannes Film Festival in 2012 by Anchor Bay. Before that, it was titled The Door, and in 2007, while Arnold was teaching at the New York Film Academy, he met Sun Jee Yoo, a student who expressed interest in raising money for his film project.

Together, they came to an agreement, put in writing, where Yoo was to use her best efforts to raise $4.5 million. She leveraged her connections back home in Korea and was able to raise the funds.

But then a dispute broke out over control.

Yoo's first efforts resulted in approximately $3.7 million raised for The Door, according to the court documents. Later, she raised an additional $1 million, but that money was said to have been put into her personal bank account and not transferred to Arnold's film company called Dark Hall Productions.

In 2007, Yoo's attorney arranged a meeting with Arnold and his own attorney and told the writer-director that he had three choices: "(1) He could continue to control the making of his movie, in which case Yoo’s father would sue him; (2) he could turn over all the investor funds to Yoo; or (3) he could give Yoo some control over the funding of 'The Door.' "

A week later, Arnold was told that he could go ahead with the film on a reduced budget but that the investors wanted $1.7 million of their money back. Arnold and Yoo drove to the bank and issued two checks out of Dark Hall's account -- $1.7 million for the investors and $1,945,000 to be deposited into a joint bank account controlled by both of them.

Instead of returning the money, Yoo is said to have put the $1.7 million into her own Dragon Noon company and later withdrew the other amount to be put into that account as well.

Dark Hall sued, and the case went to trial in 2009, where a jury awarded $3.7 million in damages against Yoo, including $1,945,000 on the film company's claim for conversion. Dark Hall filed an ex parte application seeking release of the funds, and the trial court granted it, but then Yoo informed the judge that her attorney had been disbarred.

Eventually, though, Dark Hall got its judgment confirmed, and Yoo made an appeal that there was insufficient evidence that she breached any contract or made any misrepresentation and that the judge had committed a reversible error by not instructing the jury on the law of agency.

On Wednesday, a California appeals court rejected Yoo's arguments, finding there was evidence that she agreed to raise the money but then appropriated it for her own use and that she breached subsequent oral agreements about how the funds were to be used. The appeals court also found evidence of the misrepresentations, found the jury instructions sufficient and agreed that the remedy of ordering a constructive trust imposed on the funds to be proper.

According to the decision, "That the judgment was entered only against Yoo, and not Dragon Noon, does not alter the result. It was Yoo's wrongdoing that gave rise to the constructive trust imposed on the misappropriated funds. When Yoo transferred the misappropriated funds to Dragon Noon, it became an involuntary trustee of those funds for Dark Hall's benefit."

Asiana Crash, Teen was Killed by Vehicle, Coroner Said

Newsflash from your Hollywood Attorney:

A coroner says a teenager in the Asiana Airlines crash was killed when she was struck by a vehicle at the scene.

San Mateo County Coroner Robert Foucrault on Friday disclosed the findings of his autopsy on 16-year-old Ye Meng Yuan, a Chinese student.

Foucralt said she died of multiple blunt injuries that are consistent with being run over by a motor vehicle. He did not say what that vehicle was.

San Francisco Fire Chief Joanne Hayes-White said officials believe the girl was struck by a specialized fire vehicle.
Authorities confirmed last week that Yuan was hit by a vehicle racing to extinguish flames that broke out on the Boeing 777.

Police said she was on the ground and covered in fire-retardant foam that rescuers had sprayed on the wreckage.

THIS IS A BREAKING NEWS UPDATE. Check back soon for further information. AP's earlier story is below.

A coroner plans to reveal Friday whether a Chinese student on board Asiana Flight 214 survived the crash-landing only to be killed accidentally on the runway by a firetruck racing to the wrecked, smoking plane.

The San Mateo County Coroner's Office scheduled a morning news conference to announce the cause and manner of 16-year-old Ye Meng Yuan's death.

She and her middle school classmate, 16-year-old Wang Linjia, died in the July 6 crash at San Francisco International Airport. The other victim killed, 15-year-old Liu Yipeng, died at a hospital July 12. Dozens of others were injured.

Police and fire officials confirmed last week that Yuan was hit by a firetruck racing to extinguish the blazing Boeing 777. The teenager was on the ground and covered in foam that rescuers had sprayed on the burning wreckage of Flight 214 when she was run over at least once, police said.

Rescuers discovered her body in the tire track when the truck moved while battling the flames, according to police.

Yuan and Linjia were students at Jiangshan Middle School in Zhejiang, an affluent coastal province in eastern China, Chinese state media has reported.

They were part of a group of students and teachers from the school who were heading to summer camp in Southern California. Yuan and Linjia were seated at the back of the plane, federal investigators have said.

Sony Pictures Wins 'Midnight in Paris' Lawsuit Over Faulkner Quote: "The past is never dead. It’s not even past."

Newsflash from your Hollywood Attorney:

Midnight in Paris features a protagonist played by Owen Wilson who travels to Paris and finds himself spending time with literary greats including F. Scott Fitzgerald, Ernest Hemingway and Gertrude Stein.

In the film, Wilson describes his fantastic experiences. He says, “The past is not dead! Actually, it's not even past. You know who said that? Faulkner. And he was right. And I met him, too. I ran into him at a dinner party.”

In Requiem for a Nun, Faulkner wrote, "The past is never dead. It’s not even past."

In his ruling, read here... http://www.scribd.com/doc/154578618/Faulkner-Requiem    the judge analyzes the various factors that comprise a fair use to see whether Sony's exploitation of Faulkner's passage was legitimate.

In terms of the purpose and character of the use, the judge notes "the copyrighted work is a serious piece of literature lifted for use in a speaking part in a movie comedy, as opposed to a printed portion of a novel printed in a newspaper, or a song’s melody sampled in another song. This transmogrification in medium tips this factor in favor of transformative, and thus, fair use."

As for the substantiality of the portion used in relation to the copyrighted work, the Faulkner literary estate attempted to argue that the "Quote describes the essence of Requiem," and as such deserved some extra credit for its qualitative importance.

But the judge responds, "Qualitative importance to society of a nine-word quote is not the same as qualitative importance to the originating work as a whole. Moreover, it should go without saying that the quote at issue is of miniscule quantitative importance to the work as a whole. Thus, the court considers both the qualitative and quantitative analyses to tip in favor of fair use."

Pepsi Plans to REDUCE Levels of the Cancer Chemical “by February 2014

Newsflash from your Hollywood Attorney:

A report released just before July 4th by an environmental group seems to have gotten lost in the holiday weekend haze, despite findings that link cola and cancer. Pepsi (PEP) continues to sell sodas made with 4-methylimidazole, or 4-MEI—ruled a carcinogen last year by the state of California—according to the Center For Environmental Health http://www.ceh.org/one-year-later-pepsi-still-contains-cancer-causing-food-coloring

The nonprofit group noted that Pepsi sold inside California had been reformulated to comply with state rules about the substance, yet drinks sold outside the state continue to include higher amounts of 4-MEI, which helps give the company’s cola drinks their caramel hue. The group found little to no 4-MEI in Coca-Cola (KO), which has switched to a modified caramel coloring.

In a response published in the Center for Environmental Health’s report, PepsiCo said its “coloring suppliers have been working on modifying the manufacturing process to reduce the amount of 4-MEI,” adding that drinks sold in the rest of the U.S. will have reduced levels of the chemical “by February 2014.”

Is it enough to just Reduce the Cancer Chemicals ?

UN to Inspect North Korean Ship Caught Smuggling Undeclared Weapons in Panama Found Missiles under Bags of Brown Sugar

Newsflash from your Hollywood Attorney:

A team of UN inspectors will arrive in Panama next month to examine the North Korean ship caught smuggling arms from Cuba.

"The United States have confirmed that they will send a team and the foreign minister has informed me that it is scheduled on August 5th a team of experts from the United Nations will come to verify these arms."

Five investigators will be drawn from the UN sanctions committee responsible for North Korea and will begin inspecting the Chong Chon Gang and its cargo once the vessel has been unloaded.
Panama stopped the ship last week and seized the cargo, where it found old radar, missile and aircraft components buried underneath more than 200-thousand bags of Cuban brown sugar.
Under UN sanctions, Pyongyang is banned from buying or selling weapons.

While North Korea is demanding the immediate release of the vessel and its crew, Panama has pressed criminal charges against all 35 North Korean sailors on board for endangering public security by attempting to smuggle undeclared weapons.

A statement by the Panamanian prosecutor's office said all the accused had exercised their right to remain silent.

The seizure of the vessel has cast fresh light on the North's secretive maritime trading practices and once the ship is fully inspected, the UN sanctions committee on North Korea will discuss whether Pyongyang has violated UN resolutions.

City of Detroit Pension Funds (Police and Fire Retirement System) File Lawsuit to Block Bankruptcy Filing

Newsflash from your Hollywood Attorney:

The General Retirement System of the City of Detroit and the Police and Fire Retirement System of the City of Detroit (the "Retirement Systems") announced today that they have initiated a civil action against City of Detroit Emergency Manager Kevyn Orr and Governor Rick Snyder in the Ingham County Circuit Court, Lansing, Michigan.

In the suit, the Retirement Systems challenge the authority of the Emergency Manager and the Governor to authorize bankruptcy proceedings for the City of Detroit that would in any way impair the accrued financial benefits of the Retirement Systems' plan participants and beneficiaries, said benefits being protected by Article IX, Section 24 of the Michigan Constitution of 1963.  By allowing any such impairment, the lawsuit asserts that the Emergency Manager and the Governor would be in violation of their respective oaths of office, which, pursuant to Article XI, Section 1 of Michigan's Constitution, require them to support and uphold the Michigan Constitution.

The Retirement Systems remain fully committed to working cooperatively with the Emergency Manager in his efforts to address the financial condition of the City and have fully cooperated with the Emergency Manager and his team of professionals to date.  However, the Trustees of the Retirement Systems are charged by law to make decisions and take appropriate actions that are solely in the best interests of the plan beneficiaries. The protections of Article IX, Section 24 of the Michigan Constitution represent the express will of the people of the State of Michigan and these protections cannot be subverted by a bankruptcy filing.

"The recent statements regarding an imminent bankruptcy filing, as well as the filing approximately one week ago in Ingham County Circuit Court of similar claims, prompted the Retirement Systems to take more immediate action," said Ron King, a Clark Hill attorney representing both of the Retirement Systems.

The Retirement Systems have asked the Court for a declaratory judgment that would prevent either the Emergency Manager or the Governor from taking any action which would contravene the protections of Article IX, section 24 of the Michigan Constitution.

Second Amendment Foundation Sues "Seattle" Withheld January Gun Buyback Documents

Newsflash from your Hollywood Attorney:

The Second Amendment Foundation today filed a lawsuit in King County Superior Court alleging that the City of Seattle violated the Public Records Act by withholding documents sought by SAF under a public records request relating to the city's controversial gun buyback in January.

SAF is alleging that the city did not provide all requested documents, and also heavily redacted many documents that were not protected under attorney-client privilege. SAF further alleges that the city provided some of the documents it sought to a reporter for the Seattle P-I.com and SAF only learned of the existence of these documents by reading a story on the news agency's website in June.

In addition, SAF contends that fees should not have been charged for the mere electronic reproduction of e-mails, and that the city limited its disclosures to e-mails between five city employees, and did not provide any notes, agendas or other documents relating to the buyback.

"Our request to the city for communications and documents was clear and unambiguous," said SAF Special Projects Director Philip Watson. "When I read about some communications between the staff, which were not provided to us under the PRA request, it was stunning and disappointing. I should not have to read about something we asked for, and were denied, in a newspaper article months after our request."

"Mayor Mike McGinn's staff appears to have been playing games," said SAF Executive Vice President Alan Gottlieb. "This is not a game. Government, regardless what level, needs to be accountable and transparent. If the McGinn administration believes it is above meeting the requirements of the law, they need to re-think that position."

SAF is represented by the Tempski Law Firm, PS of Bellevue.

The Second Amendment Foundation  is the nation's oldest and largest tax-exempt education, research, publishing and legal action group focusing on the Constitutional right and heritage to privately own and possess firearms.  Founded in 1974, The Foundation has grown to more than 650,000 members and supporters and conducts many programs designed to better inform the public about the consequences of gun control.

Ex-Paris Hilton Prosecutor, David Schubert Found Dead After Crack Cocaine Sentence In Vegas

Newsflash from your Hollywood Attorney:

David Schubert, 49, had completed a five-month stint in prison for crack cocaine possession in April. He was found sitting in his truck in his home's garage with the windows rolled down, according to his lawyer and friend Lou Schneier.

The Clark County coroner's office declined to comment.

Schubert spent 10 years as a Clark County prosecutor, including a stint as a liaison to a federal drug task force. He resigned in 2011 after he was arrested with $40 in rock cocaine and an unregistered handgun in his car.

He fled to Mexico to avoid jail but returned to the U.S. He told a judge he felt he had been treated exceptionally harshly.

He expected mandatory probation and a chance to wipe the felony conviction from his record. But the judge refused to consider a plea deal, calling Schubert "a disgrace to his oath as a prosecutor and a lawyer" and declaring that he wouldn't get special treatment.

Schubert told the Las Review-Journal in a jailhouse interview that he felt singled out.

"I did what I did, and I accept the consequences," he said. "But I don't feel I was treated fairly by the system."

He was isolated for his own safety in prison because of his history as a prosecutor. Schneier said that may have contributed to Schubert's poisoning sense of injustice.

The ex-prosecutor missed a check-in with his parole officer last week, Schneier said. His phone had been turned off for at least a week, possibly because he couldn't afford the bill.

After a few visits to Schubert's home, parole officers finally entered early Wednesday and found the body, Schneier said.

"I saw warning signs," he said. "Dave was extremely angry and despondent over the way he was being treated. It cost him his dignity, his law license, and finally, his life."

Schubert's sentence contrasted with those of the people he helped prosecute. Both Hilton and Mars made plea deals and avoided jail time.

The ex-prosecutor is survived by a 15-year-old son and 14-year-old daughter who live with their mother in another state.

Father Assaulted and Wrongly Arrested by Police in Front of Young Children for Driving Too Slowly Past Airport

Newsflash from your Hollywood Attorney:

Andrew Sinclair, 47, was thrown in the cells and held for around three hours after being pulled over as he drove away from the terminal.

The mechanic has now won compensation after a County Court jury ruled there had been no justification for detaining him outside Manchester Airport.

Mr Sinclair, from Stockport, was stopped because he was not driving quickly enough as he waited for his partner Michelle Saddoo, 40, to catch up in another car as he collected his son.

As the father explained the situation to the motorcycle officer, police from a nearby Tactical Aid Unit - which had been called to manage an immigration protest at the airport - became involved in the dispute in March 2009.The father was pushed to the ground by around half-a-dozen officers and arrested in front of his partner and their children before being taken to a police station.

Officers later claimed he had been arrested for a breach of the peace outside Terminal Two. But a jury at Manchester County Court ruled there had been no justification for detaining him.

Mr Sinclair said: 'As soon as the Tactical Aid Unit officers came over they seemed to have adopted an aggressive, bullying attitude and started searching the car and pushing me around before they threw me to the floor.

'They never explained to me that I'd been arrested and they just locked me up, then a few hours later they released me without any explanation. I knew what had happened wasn't right and that night I decided I was going to fight it.

'I'm just a normal person and for four years this has always been at the back of my mind and caused me a lot of stress but it was something I didn't want to just let go, because they abused their power and like anyone else the police need to be held to account.'Mr Sinclair was collecting his son, Reis, and the 23-year-old's Honda Civic car as he was unable to drive himself home after suffering head injuries, a broken wrist and broken collarbone in a motoring accident while on holiday in Dubai.

Ms Saddoo was supposed to be driving the family car home with their two young children Aliyah, three, and four-month-old Tayo in the back seat.

She said: 'We were just a normal, everyday family going about our normal, everyday business and there was no reason whatsoever for them to behave in the way they did.

I.D. Theft Stole from Elderly for Disney Trips, Courtside Tickets, More Spending Spree

Newsflash from your Hollywood Attorney:

The ringleaders of an alleged identity theft scam of senior citizens were arrested after they posted photos of their Disney World engagement and purchases on Facebook that was paid for with their ill-gotten gains, police announced.

Amanda Zieminski, 27, and Clyde Forteau, 29, both of New York City, were arrested and indicted for 64 criminal acts including identify theft, falsifying business records, and grand larceny, the Staten Island District Attorney's office said in a statement Wednesday.

Zieminski and Forteau allegedly used the stolen money to pay for courtside seats at a 2012 NBA Finals game, a vacation to the Dominican Republic, and a vacation to Disney World, where they got engaged in front of Cinderella's castle, according to police.

"But make no mistake, Amanda Zieminski is no Cinderella and Clyde Forteau is far from Prince Charming," said Staten Island District Attorney Daniel M. Donovan, Jr.

Zieminksi and Forteau are accused of stealing the Social Security numbers and credit card information of more than 80 elderly patients from a Staten Island medical center where Zieminski once worked, police said.

Forteau, 'C-Money CEO,' used the information to file false tax returns and had the refunds sent to his personal bank accounts. Forteau allegedly had his victims' Social Security payments sent to his own accounts. He posed as a Hurricane Sandy victim who lost his home to explain the diverted money to bank officials, police said.

Police were able to identify Zieminski and Forteau after a year-long investigation, which included a Google search that revealed photos of their purchases and vacations posted on the couple's public Facebook accounts. The purchases and vacations the couple flaunted matched the items charged to the stolen credit card accounts, according to the statement.

Police discovered more than 50 stolen credit cards and 20 fake driver's licenses when they arrested Zieminksi and Forteau, according to the statement.

Amanda  Zieminski, 26, accused of stealing 80 patient files from Staten Island clinic  where she worked as a nurse until December

Police also charged and arrested three other alleged accomplices.

All the defendants pleaded not guilty, according to Douglas Auer, a spokesman for the Staten Island District Attorney's office.
