Lady Gaga Takin to Crout in Ex-Assistant's On-Call 24/7 Lawsuit

Jennifer O'Neill says she was cheated out of overtime wages after claiming to be available to the pop star 24 hours a day, seven days a week.

A onetime roommate and friend of Lady Gaga who claimed after serving as her personal assistant for more than a year that the pop singer cheated her out of overtime wages can tell her story to a jury in November, a judge said Tuesday.

A jury can decide whether Gaga's demands left Jennifer O'Neill any personal time or whether she was on call 24 hours a day, seven days a week, as she claimed in her 2011 lawsuit, U.S. District Judge Paul Gardephe said. A trial is set for Nov. 4.

O'Neill worked for the singer for one to two months in early 2009 and for 13 months beginning in February 2010. The judge said both sides agree she was expected to be available as needed throughout each hour of each day.

Gardephe ruled that O'Neill's "on-call" time potentially qualifies for overtime compensation.

O'Neill said she was paid at a flat rate of about $50,000 annually when she was first hired and $75,000 annually the second time by the pop singer, who is estimated in a list published by Forbes magazine to have earned $80 million in the first six months of this year.

In his written decision, Gardephe noted that lawyers said Lady Gaga, listed in the litigation under her birth name -- Stefani Germanotta -- and O'Neill frequently slept in the same bed because O'Neill never had her own hotel room while on tour and was required to address Lady Gaga's needs throughout the night.

O'Neill had testified in a deposition that if Lady Gaga was watching a DVD in the middle of the night and grew tired of it, she woke her up to take out and replace the DVD.

"Every day is a work day for her, so every day is a work day for the rest of us," she said. "There is no, 'We're going to stay in, we're going to sleep.' There is no, 'Let's put on sweatpants and go out to the movies and be girlfriends.' It doesn't work like that," O'Neill said.

In her deposition testimony, Lady Gaga had testified: "You don't get a schedule. You don't get a schedule that is like you punch in and you can play ... at your desk for four hours and then you punch out at the end of the day. This is, when I need you, you're available."

O'Neill had testified she was responsible for sometimes monitoring the singer's e-mail and telephone communications and for handling all her luggage -- generally 20 bags -- including clothing, accessories, makeup and toiletries.

She was also responsible for making sure that "special food" was available at every location and for ensuring that the singer arrived at performances on time and had ample time for hairstyling, makeup and voice warm-ups, O'Neill claimed.

She said she assisted with costume changes during performances and was responsible afterward for arranging ice packs, tea and a shower, along with dinner and an exit from the venue.

The judge noted that the women met after Lady Gaga moved into O'Neill's apartment building on the Lower East Side of Manhattan before 2008, when they became roommates and friends. O'Neill was offered a position as her personal assistant because they were friends, and she had experience in the music industry, court papers said.

Two Con-Men Got Millions out of Concert Promoters and Organizers

Two men were arrested in New York on Thursday on suspicion of duping concert promoters out of millions by pretending to be the managers of Lady Gaga, Ke$ha and Rihanna.

Sylvester Vincent Carroll and Meceo McEaddy are accused of stealing more than $2 million by convincing promoters around the world into believing they were booking the superstars for concerts. According to the district attorney's office, the pair convinced a Brazilian event company to pay $825,000 in 2010 by using a fake email account in the name of Rihanna's manager.

They then allegedly tricked a Mexican promoter into paying for Lady Gaga to perform, and also targeted concert organizers in Long Island, New York, and Taiwan. The pair was charged with felony grand larceny and scheming to defraud in the first degree. Carroll faces an extra count of criminal tax fraud. Both men remain in custody.

Lady Gaga Concert Promoters Sue 'Despicable' Insurer Over Terrorism-Related Cancellation


The pop star was pulled from a concert in Indonesia last year amid a mounting protest from various Islamic or other groups. Now Live Nation LGTours says it has suffered substantial damage.

As concert promoters discuss with insurers who will be responsible for picking up the cost of a cancellation that is estimated at $25 million, a legal dispute has erupted over the withdrawal of the pop singer from a concert in Indonesia on an earlier leg of the tour.

Gaga (real name: Stefani Germanotta) was scheduled to perform in Jakarta on June 3, 2012, but various Islamic or other groups began mounting a protest. She backed out, and now Live Nation LGTours says it has suffered substantial damage.

Live Nation, Mermaid Touring and The Atom Factory are now suing a Lloyds of London syndicate for allegedly not living up to the terms of a "Terrorism Policy," accusing the defendant of "despicable conduct that subjected Plaintiffs to cruel and unjust hardship in conscious disregard of the Plaintiffs rights... with the intent to vex, injure or annoy the Plaintiffs, such as to constitute oppression, fraud or malice..."

Insurance disputes aren't usually this searing.

In advance of the scheduled Lady Gaga concert in Indonesia, many local papers covered the threats.

For example, the Jakarta Globe reported on May 17, 2012 that the "hardline Islamic Defenders Front (FPI) said it would dispatch 30,000 of its members to prevent Gaga from entering Jakarta."

Local police were also reported that it couldn't guarantee the security for Lady Gaga.

According to the lawsuit filed in California federal court, the concert was canceled in order "to prevent bodily injury and property damage and to protect the lives and safety of Lady Gaga, all members of the Born This Way Tour, and the public."

Afterwards, Live Nation attempted to collect on its "Terrorism Insurance" policy, which the plaintiff says they paid a substantial premium to obtain. The language of the policy stated indemnification for the "ascertained net loss" for cancellations due to "the sole and direct result of Terrorism and/or Sabotage or Threat."

The plaintiff is seeking at least $75,000 of Ascertained Net Loss for breach of contract and breach of the implied covenant of good faith and fair dealing. In addition, punitive damages are being sought.

Leslie Kee (Japanese Celebrity Photographer) Arrested for Selling Lewd Photos


Celebrity photographer Leslie Kee is well known in the entertainment industry—he’s worked with everyone from Lady Gaga to Beyonce, G-Dragon and Ayumi Hamasaki. He was arrested this week in Tokyo, Japan for distributing lewd photos with male genitalia. His fans and Japanese fashion icons are protesting his arrest, as he was selling copies of his book inside a gallery. His show “FOREVER YOUNG” violated Japan’s law that requires censorship of genitals.



The 41-year-old, Tokyo-based photographer is facing a large fine after his arrest. In the video below, he has a short interview about how he grew up (spoken in English). He was introverted as a child, growing up as the child of a prostitute. Kee’s mother passed away when she was 13 years old. Before she passed, she asked Kee what he wanted as a gift. Leslie asked for a camera so he can take photos of his younger sister, as he has had no photos of himself or of anyone else growing up.


If this was an issue in the US icons such as Robert Mapplethrope would have been deemed obscene a long time ago. Wait, HE WAS? Well, come on Japan, its 2013!
