What To Do If You Are Arrested - Important Information

Being arrested is a frightening and confusing experience.  To make matters worse, most people's knowledge of the arrest, booking and bail process is colored by TV shows that may have little basis in reality.

Arrest Tips:

       1. Stay Calm.   Even if you think the police are making a mistake when they arrest you, stay calm and be cooperative.  Don't argue with the police or threaten them with a lawsuit.  Don't try to run away or touch the police officers.  Doing any of these things could trigger a charge of resisting arrest, which will only make a bad situation worse.

       2. Give Your Real Name.  No matter how embarrassed you are about the arrest, give your real name.  Using a false name will further complicate things, especially when your lawyer or bail bond agent needs to contact the jail.

       3. Be Careful What You Say.  It's a cliché from a thousand cop shows, but anything you say can indeed be used against you.  That's true during the arrest, during booking and during police interrogation. It's also true of telephone and other inmate conversations you have while in jail.

       4. Make a Phone Call.  Despite what you've seen on TV, there is no federal right to make a phone call. In fact, laws on this vary from jurisdiction to jurisdiction.  Some jails have payphones in the holding cell; others don't. In the latter case, you have to rely on the good graces of the police to allow you to call someone.   Keep in mind that most cell phones do not accept collect calls which you may be required to make.

       5. Beware of Bail Bond Scams.  You will likely need to pay bail to be released from jail. Most people cannot afford to post bail themselves, and need to contact a bail bond agent to post bail for them.  


Licensed, ethical bail agents will charge you a percentage of the total bail amount for their service.  In California, this amount is set by the state legislature. Beware of anyone charging less that this. They are either violating state rules, or practicing a bait-and-switch that ends up charging you more down the road.
