LEGO wins Watch packaging court case


Watch company can no longer use packaging similar to LEGO's iconic brick.

LEGO has won a legal battle against Belgian company TKS which produces the Ice Watch.

The Brussels Court of Appeal has issued a pan-European injunction against Ice Watch packaging (pictured), furniture and other items, after it found the packaging was 'confusingly similar' to LEGO's 3D trade marks.

The court said that a "significant percentage" of the public is confused as to the commercial origin of the goods.

As part of the injunction, parts of the judgment must be displayed on the TKS website homepage for one month. The firm has 90 days to comply with the terms of the injunction.

If TKS violates the injunction, it must pay LEGO €200 per infringing product and €10,000 every day as long as the infringement continues.

"By issuing a pan-European injunction, the Brussels Court of Appeal has sent a very clear message to all EU market players that produce or trade in products with a shape confusingly similar to the LEGO Group’s trade marks," said LEGO Group’s Belgian counsel, Tanguy de Haan, and Florence Verhoestraete of NautaDutilh Brussels.
